These Terms of Service govern your access to and use of SoulTrack (https://soultrack.io), an AI-powered music generation web application operated by an individual operator based in Japan. By accessing or using SoulTrack, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the service.
Service Description
SoulTrack is a free web application that allows users to generate original audio tracks using the MusicGen AI model via Replicate's API. Users submit a text prompt describing the desired music, and the service returns an AI-generated audio track accessible via a public URL. No user account is required to generate music. Optionally, you may create an account using your email address to save generated tracks to a personal library and to generate tracks without the daily IP-based rate limit.
Acceptable Use
Use of SoulTrack by unauthenticated users is subject to a rate limit of 3 generated tracks per day per IP address to ensure fair access for all users. Authenticated users (those who have signed in with an account) are not subject to this IP-based rate limit. You agree not to use SoulTrack to generate content that is harmful, illegal, defamatory, obscene, infringing of third-party intellectual property rights, or otherwise in violation of applicable law. You must not attempt to circumvent rate limits, reverse-engineer the service, or use automated means to abuse or overload the platform. We reserve the right to block IP addresses or suspend accounts of users who violate these terms.
AI-Generated Content
All audio tracks produced through SoulTrack are generated by an AI model (MusicGen) and do not represent the creative expression of a human author. Under applicable law (including Japanese copyright law), AI-generated works without sufficient human creative contribution may not qualify for copyright protection, and the operator makes no claim of copyright ownership over such tracks. You are free to use, download, share, and adapt the audio tracks you generate through SoulTrack for personal and commercial purposes, subject to these Terms. You acknowledge that AI-generated content may be similar to outputs generated for other users, and that we make no representation that generated tracks are free from third-party intellectual property claims. Tracks generated without an account are available via a public URL for 24 hours and are permanently deleted thereafter. Tracks saved to your library as an authenticated user are stored indefinitely until you delete them; they are publicly accessible via their track URL and are listed in SoulTrack's public sitemap, which means they may be indexed by search engines such as Google. If you do not want a track to appear in search results, delete it from your library. You are responsible for saving any tracks you wish to retain.
Service Limitations
SoulTrack is provided on a best-effort basis and may be subject to downtime, rate limiting, or changes without prior notice. Generated tracks are stored for a maximum of 24 hours and cannot be recovered after deletion. We do not guarantee the quality, originality, or fitness for any particular purpose of AI-generated audio. The service may be modified, suspended, or discontinued at any time at our sole discretion.
Disclaimer
SoulTrack is provided 'as is' and 'as available' without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by applicable law (including the Consumer Contract Act of Japan (消費者契約法)), the operator of SoulTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the service. Nothing in these Terms excludes or limits liability for damages caused by the operator's intentional misconduct or gross negligence. Your use of SoulTrack is entirely at your own risk.
Changes to These Terms
We reserve the right to modify these Terms of Service at any time. When we make material changes, we will update the 'Last updated' date at the top of this page. Your continued use of SoulTrack after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the use of SoulTrack shall be subject to the exclusive jurisdiction of the Japanese courts, with the Tokyo District Court serving as the court of first instance.
